This Privacy Policy identifies the information (including personal data as defined under GDPR) that Egnyte may collect about you at our website or through our services and describes how Egnyte uses and protects such information. It also describes the choices available to you regarding our use of your personal data and how you can access and update this information. The use of information collected through our service shall be limited to the purpose of providing the service for which the Customer has engaged Egnyte.

Under certain circumstances, California residents visiting our website or using our services may have rights under the California Consumer Privacy Act (“CCPA”) and California Privacy Rights Act of 2020 (“CPRA) in relation to their personal information. While Egnyte complies with other privacy legislation, much of which already addresses requirements raised under the CCPA and CPRA, Egnyte has nevertheless identified provisions below highlighting California residents’ rights under CCPA and CPRA.

What Information Is Collected

You may visit our website anonymously and learn about Egnyte's services.

We collect personal data about you through the website only if you voluntarily provide it to us, when you use an online registration form to create an account for use of the Egnyte service, to submit a reseller inquiry, or to request additional information about our services through our website, web chat, email, and any other means. You are required to pick a password and username when you use our online registration form to create an account for use of Egnyte services and to provide your first name, last name, phone number, and email address in all other inquiries. When you access our website, we automatically collect information on the type of device you use, system and performance information, operating system version, Internet Protocol (IP) addresses, User Agent type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. Additionally, we might identify: a. the website through which you arrived at our website (i.e. via clicking a link); b. the search engine or paid social media through which a search brought you to our website (and possibly your search parameters); c. the details of your interactions with advertisements we have placed on other websites; and d. the demographics (i.e. company name, size, type of industry, geographical location of the company or visitor) associated with returning visitors or visitors whose companies are customers of Egnyte, which allows us to customize messages and offerings. We may also ask you, but you are not required to provide, information regarding how you learned about Egnyte. Please understand that Egnyte hosts its website in the United States, so if you are providing Egnyte with any personal data, you are consenting to that data being collected and processed in the United States in accordance with the terms of this Privacy Policy.

Egnyte also collects information at the direction of its Customers and has no direct relationship with the individuals whose personal data it processes. Egnyte works with its Customers to help them provide notice to their users concerning the purpose for which personal data is collected.

We collect information for our Customers, so if you are a user of our services through one of our Customers and would no longer like to be contacted by one of our Customers that use our service, please contact the Customer that you interact with directly. If you purchase a service from us, we request certain personal data from you and Customer users on our order form. You must provide contact information (such as name and email) and financial information (such as credit card number, expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

When you download and use our mobile application “Egnyte”, we automatically collect information on the type of device you use, system and performance information, and operating system version. We also collect personal data through the mobile app, such as name, telephone number, email address, and IP Address. Sensitive personal data may also be collected through the mobile app, such as credit card information. The application will also request access to allow the use of your device’s camera to allow the app to use the camera sensor to take pictures and videos, and it will also request access to your photo storage to allow it to read, modify, or delete access to protected storage.

Personal data is also acquired through third party relationships secured as a result of our sustained efforts at marketing the Egnyte brand. Prior to engaging with such third parties, Egnyte makes reasonable efforts to ensure these parties have acquired personal data via legitimate and appropriate means.

Use of Information

Egnyte Users

We use your contact information and unique identifier (such as a username and password) to provide access to the Egnyte service and to contact you when reasonably necessary. We may also use any information you have provided as reasonably necessary to administer or provide customer support for the website and the Egnyte service. We use the information submitted by you to send you correspondence and other information that may interest you and to respond to your correspondence. If, for any reason, you would like to be removed from our email list, you can send us an email at privacy@egnyte.com or follow the unsubscribe information contained in each of the emails you receive.

Based upon the personal data you provide us, we will send you a welcoming email to verify your username and password. We will also communicate with you in response to your inquiries, to provide the services you request, to manage your account, and to help us improve our customer support and overall service to you. We will communicate with you, by email or telephone or by text message, and will make reasonable efforts to accommodate your communication channel preference. We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email and/or text message. Generally, you may not opt-out of these key communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account. If you wish to subscribe to our monthly newsletter, we will use your name and email address to send the newsletter to you. Our newsletters contain important information such as updates and enhancements to our services. Out of respect for your privacy, we provide you a way to unsubscribe through the unsubscribe instructions contained in the emails you receive, or you may contact us at privacy@egnyte.com.

We send you push notifications from time-to-time to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your device such as operating system and user identification information.

Finally, if you use the Egnyte service, we will store the data you upload onto our servers. All your data is encrypted at rest. If you are a Power User with administrator capabilities, you may manage the Address Book, which includes inputting other Power Users' and Standard Users' first names, last names, and email addresses. You, as a regular Power User, may manage the Address Book that includes inputting Standard Users' first names, last names, and email addresses. Email communications resulting from the management of the Address Book is limited to the initial setup of Power User and Standard User accounts. Since Egnyte does not access your account, you, not Egnyte, shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and copyright of all data you upload into your account. Furthermore, Egnyte shall not be responsible or liable for your deletion, correction, or failure to store any data.

Non-Users

If your personal data is in our systems and identified as being associated with a potential customer, from time to time you might receive communications from us seeking to engage in a dialogue about the type of services we offer that may be of interest to you. Out of respect for your privacy, we provide you a way to unsubscribe through the unsubscribe instructions contained in any emails you receive, or you may contact us at privacy@egnyte.com.

Disclosure of Information

We will share your personal data with third parties only in the ways that are described in this Privacy Policy.

If you are a user of our services, we may disclose your personal data to certain third-party vendors (e.g., data storage facilities, payment processors, CRM solution providers, email service providers) who provide important ancillary services to Egnyte. These third parties are prohibited from using your personal data for any other purposes. Transfers to third parties are covered by the services agreements with our Customers, so if you have any questions in regard to this, you should reach out to the Customer through which your account is being serviced. Additionally:

  1. We may send email communications to selected groups of Egnyte users on behalf of our company and on behalf of other businesses in whose products, services and/or enhancements thereto such users may have an interest; but we will not initiate the disclosure of any personal data to such businesses. We will also include in each such email instructions as to how our users can permanently opt-out of receiving any such future emails. In addition, you may contact us at privacy@egnyte.com to request that your information no longer be used in this manner.
  2. In certain situations, Egnyte may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We also reserve the right to disclose your personally identifiable information if we reasonably believe we are required to do so by law, regulation, or other government authority and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our website.
  3. Finally, we may disclose your personal data upon a transfer or sale to another entity of all or substantially all of Egnyte's assets or stock in Egnyte's line of business to which this Privacy Policy relates or upon any other corporate reorganization. (If, for example, in the future, we undergo any sort of corporate reorganization, we may need to transfer your personal data to the surviving entity.) You will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your personal data, as well as any choices you may have regarding your personal data.

If you are not a user of our services and your personal data was acquired through our marketing activities, we might share your personal data with third parties in an effort to engage in communications with you. We will also include in each communication via email instructions as to how you can permanently opt-out of receiving any such future emails and the sharing of such information. Updating Your Information

Users of Egnyte Services

Egnyte collects information under the direction of its Customers and has no direct relationship with Customer users (other than administrators) whose personal data it processes. A Customer user who seeks access to data, who seeks to correct, amend, delete inaccurate data, or withdraw consent to further contact should direct his/her query to Egnyte’s Customer (the data controller). If the Customer requests Egnyte to remove the data because they are unable to do so, we will respond to its request within a reasonable time.

You have the ability to update any of your personal data previously submitted to Egnyte within the Account Settings section of your account when logged in.

We will retain your personal data used in processing on behalf of Customers for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Non-users

For non-users of Egnyte’s services, upon request, Egnyte will provide you with information about whether we hold, or process on behalf of a third party, any of your personal data. If you would like to access your personal data in order to correct, update, or delete it, you may contact us directly at privacy@egnyte.com. Requests for access will be responded to within a reasonable timeframe.

Blog/Testimonials

If you submit information to a blog or provide a testimonial on our website, you should be aware that any personal data you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. For testimonials, we obtain the individual's consent prior to posting his or her name and photograph along with the testimonial. We are not responsible for the personal data you choose to submit in these forums. If you want to remove your personal data that is being displayed on our website under public pages, please contact us at privacy@egnyte.com.

A Special Note about Children

Our website does not gather any personal data from children that we know are under the age of 13 and our Services are not directed for usage of such children. We believe strongly that parents should play an integral part in their child's online experience and should monitor that activity to ensure online sites are respecting their child's privacy.

Log Files

As is true of most websites, we gather certain information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, User Agent type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use this information to analyze trends, to administer the site, to track users' movements around the site and to gather demographic information about our user base as a whole.

We use third-party tracking services that use cookies and advertising IDs to track non-personal data about visitors to our site in the aggregate. Information tracked includes the search engine used by a visitor, keyword input by a visitor, location, gender, age, aggregated categories of interest and search campaign associated with a visitor. The information is captured for marketing and Customer segmentation purposes.

Tracking Technologies

Egnyte and its partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our website or service.

Contextual and Behavioral Targeting / Re-Targeting

We partner with a third party to either display advertising on our website or to manage our advertising on other sites. Our third-party partner may use technologies such as cookies to gather information about your activities on our website and other sites in order to provide you advertising based upon your browsing activities and interests. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here (or if located in the European Union click here). Please note this does not opt you out of being served ads. You will continue to receive generic ads.

Mobile Analytics

We use mobile analytics software to allow us to better understand the functionality of our Mobile Software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. When you download and use our Services, we automatically collect information on the type of device you use and operating system version.

Links to Third Party Websites

We may place from time-to-time links on our website to one or more websites for our affiliates. Some affiliates may collect personal data when you access their links or when you indicate you would like to participate in a special offer. When you click on a link to a third-party website from our website, your activity and use on the linked website is governed by that website's policies, not by those of Egnyte. We encourage you to visit their websites and review their privacy and user policies, as this Privacy Policy does not apply to such third-party websites.

Security Measures

The security of your personal data is important to us. When you enter sensitive information (such as credit card number) on our registration or order forms, we use reasonable security to encrypt that data and send it securely. We offer you two-step verification when you access your account. Consistent with legal requirements and the demands of Egnyte’s high standards for service security, our website and services employ procedural and technological measures reasonably designed to protect your personal data and your other data from loss, misuse or unauthorized access, disclosure, alteration, or destruction, including using secure servers for data storage.

Social Media Features and Widgets

Our Web site includes Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Web site. Your interactions with these features are governed by the privacy policy of the company providing it.

CCPA and CPRA

The following provisions are supplemented by other commitments and statements Egnyte makes under this Privacy Policy that are required by CCPA and CPRA, and in some instances may even repeat those commitments and statements. The usage of the term “CPRA” throughout this Privacy Policy shall also include CCPA where portions of CCPA remain applicable post-CPRA. In case of any conflict, the terms of this section will prevail as to personal data of California residents that is subject to CPRA. For purposes of this section, the term “personal data” includes all “personal information” as defined in the CPRA, and the term “sensitive personal data” includes all “sensitive personal information” as defined in CPRA. Egnyte is a “service provider” under CPRA vis-à-vis users of its services, and Egnyte may be considered a “business” under CPRA vis-à-vis non-users insofar as Egnyte shares the personal information of non-users with contractors or service providers.

Egnyte does not solicit for collection, selling, or sharing any sensitive personal data of users of Egnyte’s services. Users may upload information into Egnyte’s services that may be considered sensitive personal data, but that would be done at the users’ own discretion and users would have the ability to manage such data as they deem necessary.

If we intend to share your personal data with contractors or service providers in accordance with this Privacy Policy, we will only do so pursuant to an agreement with each recipient requiring it to comply with CPRA and, in particular, specifying:

  1. that the personal data is shared by us only for limited and specified business purposes;
  2. that the service provider or contractor must comply with applicable obligations of CPRA and provide the same level of privacy protection as is required by CPRA;
  3. the rights granted to us to take reasonable and appropriate steps to ensure that the service provider or contractor uses the personal information transferred in a manner consistent with our obligations under CPRA;
  4. that the service provider or contractor must notify us if it decides it can no longer meet its obligations under CPRA; and
  5. that we have the right, upon notice, to take reasonable and appropriate steps to stop and remediate unauthorized use of personal data.

We do not intend to share or sell your personal data to “third parties,” as defined under CPRA. Further, we do not intend to engage in cross-contextual behavioral advertising with third parties.

Under certain circumstances, California residents have the following rights in relation to their personal data:

  • Right of access and data portability. You may have the right to request that we disclose to you information about our collection and use of your personal data in the preceding 12 months, including: (a) the categories and specific pieces of personal data we collect; (b) the categories of sources from which we collect personal data; (c) the business or commercial purpose for which we collect personal data; (d) the categories of third parties with whom we share personal data; and (e) the categories of personal data disclosed for a business purpose or sold to third parties and the categories of third parties to whom such personal data was sold or disclosed.
  • Right to deletion. You may request that we delete certain personal data that we have collected about you. The foregoing is subject to our right to maintain your personal data for specific purposes permitted under CPRA. If we are unable to comply with any such request, we will notify you. Additionally, we will contact contractors, service providers, and vendors to whom we have shared personal data and instruct each to delete your personal data. If you are a user of our services, you should first reach out to the Egnyte Customer’s appointed services administrator, and if that individual requires our assistance, he/she may contact Egnyte support.
  • Right of correction. You may have the right to request that we correct any personal data within our systems that you reasonably believe to be held in an accurate format, and we will use commercially reasonable efforts to make the requested corrections. If you are a user of our services, you should first reach out to the Egnyte customer’s appointed services administrator, and if that individual requires our assistance, he/she may contact Egnyte support.
  • Right to opt-out. You may have the right to request that your personal data not be sold to third parties or shared for the purpose of cross-context behavioral advertising.
  • Right to non-discrimination. You have the right to exercise any of the rights listed above (and any other rights under CPRA) without discrimination by us.
  • Data minimization. We will only keep consumer personal data for the limited purposes set forth above in this Privacy Policy. We may keep user personal data for the purposes laid out in the agreement under which the user gained access to our services, subject to any data minimization provisions contained therein.

Policy Changes

Due to the Internet's rapidly evolving nature, Egnyte may need to update this Privacy Policy from time to time. If so, Egnyte will post its updated policy on this system. We reserve the right to modify this Privacy Policy at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our home page prior to change becoming effective.
